End User Licence Agreement (EULA)

1. Licence Grant

1.1 Personal Licence: Subject to the terms of this Agreement, Interactive Weather Limited grants you a non-transferable, non-exclusive, revocable licence to download, install, and use the App for personal, non-commercial purposes on your individual device(s).

1.2 Commercial Licence: If a separate commercial agreement is entered into between Interactive Weather Limited and you or your business, the App may be used for commercial purposes strictly in accordance with the terms of that agreement. No commercial use is allowed without such an agreement.

2. Application Platform and Support

2.1 Platforms: The App is available for use on iOS, Android, and Web platforms.

2.2 Support: We do not guarantee ongoing support for any specific platform, but we will provide updates and support where feasible, as outlined in our terms and Privacy Policy.

2.3 Mobile Features: Some features, including push notifications, mobile device registration, and mobile device location updates, apply only to the iOS and Android mobile applications and not to the browser or desktop applications unless we say otherwise.

3. Transfer and Sublicensing

3.1 Non-transferable: This licence is non-transferable, and you may not assign or transfer your rights or obligations under this Agreement to any third party.

3.2 No sublicensing: You may not sublicense the App or its functionality without explicit written permission from Interactive Weather Limited.

4. Device Usage

4.1 Device Restriction: The App is licensed to be used only on individual devices owned by you, unless a separate purchase agreement stipulates otherwise.

5. Fee for Use

5.1 Free for Personal Use: Unless otherwise agreed in a commercial agreement, the use of the App is provided to individual users without charge.

6. Data Collection and Privacy

6.1 Data Collection: Interactive Weather Limited may collect, store, and process personal data in accordance with our Privacy Policy. This includes, where applicable, your name, email address, and a securely hashed version of your password when you create an account.

6.2 Location Data: The App may process location data to provide weather, map, and alert functionality. In the iOS and Android mobile applications, we store the latest location received from your device server-side and use it to send weather alert notifications for your current or most recently reported area. Weather alert notifications are only sent to your device if we hold a current location for it; if no location has been received and stored, no weather alert notifications will be delivered. If you grant background location permission, the App may send location updates when your device records a movement, keeping your stored location current even when the App is not in use. If you do not grant background location permission, the App may send a location update when you open or use the App, and periodically while the App remains open. We do not store a location history in the live service, although previous locations may remain temporarily in backups as described in our Privacy Policy.

6.3 Partner Location Sharing: Users may choose to opt in to share approximate location data with our partners, such as Hall Enterprises. This location data is represented only in approximate form, with no account identifier intentionally shared for that feature. Location sharing with partners requires your explicit action and can be stopped at any time by disabling the location-sharing feature within the App.

6.4 Mobile Device Identifiers and Push Tokens: The iOS and Android mobile applications generate a device UUID and receive a Firebase Cloud Messaging token before you grant notification permission. We use these identifiers to register the device, manage notification delivery and preferences, diagnose notification issues, and operate the App. If you log in or register, the mobile device record is linked to your account.

6.5 Third-party Data Sharing: Data may be shared with third-party services for the purposes of hosting, database services, analytics, push notification delivery, diagnostics, customer support, subscription management, and service delivery, as described in our Privacy Policy.

7. User Accounts and Registration

7.1 Account Optionality: Creating a user account is optional. All app features, including premium subscriptions, are accessible without registration.

7.2 Registration Information: If you register an account, you will be asked to provide your name, email address, and password. This information is stored securely on servers managed by a cloud provider.

7.3 Password Security: Passwords are stored using secure hashing (bcrypt). We recommend using a strong, unique password for your account. Future support for two-factor authentication (2FA) may be introduced.

7.4 UUID for Subscriptions: Upon registration, a UUID is assigned to your account to enable subscription recognition across devices. This UUID is visible in your account and may be used in customer support interactions.

7.5 Mobile Device Linking: If you use the iOS or Android mobile application and log in or register, your mobile device record is linked to your account. If you log out, the device record is unlinked from your account. If you delete your account, associated mobile device records are deleted from the live service, subject to backup retention described in our Privacy Policy.

7.6 Account Deletion: You may request deletion of your account and associated data by contacting support at [email protected].

7.7 Misuse: We reserve the right to suspend or terminate any account in cases of misuse, abuse, or breach of this Agreement.

8. Subscriptions and Payment Processing

8.1 Subscription Management: Subscriptions are managed through third-party platforms, including the Apple App Store, Google Play, and RevenueCat. Interactive Weather Limited does not collect or store user payment information.

8.2 Payment Disputes: Any payment disputes or billing issues should be directed to the relevant app store (Apple or Google). In rare or exceptional circumstances, Interactive Weather Limited may handle payment issues directly at its discretion.

8.3 Refund Policy: Refunds are subject to the policies of the respective app store. Users should refer to the Apple App Store or Google Play refund policies for guidance on refund requests.

8.4 Pricing: Subscription prices may change due to updates from the app stores. Users will be notified of any changes in accordance with the policies of the respective platform.

9. Third-Party Software and Services

9.1 Third-Party Services: The App may integrate or link to third-party services, but we are not responsible for their operation. Any third-party services are governed by their own terms and conditions.

10. Push Notifications and Alerts

10.1 Optional Notifications: Push notifications are optional and available only in the iOS and Android mobile applications unless we say otherwise. You may enable, disable, or configure notification categories in the App and through your device settings.

10.2 Best-effort Delivery: Weather alerts, push notifications, and other app notifications are provided on a best-effort basis. They may be delayed, unavailable, duplicated, missed, or affected by device settings, operating system restrictions, connectivity, third-party services, battery settings, app permissions, or other factors outside our control.

10.3 Location-based Alerts: Weather alert notifications are sent using the last location stored server-side for your mobile device. If no location has been received and stored — because location permissions have not been granted or no update has yet been sent — weather alert notifications will not be delivered. If background location is disabled, the stored location may become outdated when you are not actively using the App, which may affect the accuracy of location-based alerts.

10.4 Not an Emergency Service: The App is not an emergency service, public warning system, weather radio, or substitute for official weather warnings, emergency alerts, or instructions from public authorities. You should maintain backup sources for severe weather and emergency information.

11. Ownership

11.1 Ownership of Rights: The App and all rights, including intellectual property rights, are owned by Interactive Weather Limited.

11.2 Licence Limitations: This Agreement does not grant you any ownership rights to the App but only a limited licence to use the App as specified in this Agreement.

12. Termination

12.1 Breach of Terms: This Agreement will automatically terminate if you breach any term. In such cases, you must immediately stop using the App and delete it from your devices.

12.2 Additional Termination Rights: We reserve the right to terminate or suspend your access to the App or your user account if required by law, regulation, or in case of repeated violations or misuse.

13. Commercial Use

13.1 Commercial Use Restrictions: Commercial use of the App, which includes any use where the App's data or functionality forms part of a business offering or provides services to customers for profit, is strictly prohibited without a formal Commercial Agreement between you and Interactive Weather Limited.

14. Disclaimer of Warranties

14.1 Accuracy and Availability: While we make every effort to keep the App's data accurate and up-to-date, we make no warranties or representations, express or implied, regarding the completeness, accuracy, reliability, availability, timeliness, or delivery of the App, weather data, alerts, notifications, or related services.

14.2 As-Is Basis: The App is provided on an "as is" basis, and you use it entirely at your own risk. We disclaim any liability for any reliance placed on the App's data, alerts, notifications, or services.

15. Limitation of Liability

15.1 Limitation: To the maximum extent permitted by law, Interactive Weather Limited shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use of or inability to use the App, including any delayed, missed, inaccurate, unavailable, or stale notification or alert, even if we have been advised of the possibility of such damages.

16. Governing Law and Jurisdiction

16.1 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of England and Wales.

16.2 Jurisdiction: Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England.

16.3 Age Restrictions: You must be at least 16 years of age to register an account or use the App where personal data is processed, in accordance with GDPR requirements.

17. Notices

17.1 Contact Information: Any notices required to be given under this Agreement must be sent to Interactive Weather Limited by email at [email protected] or by mail to our registered office at Interactive Weather Limited, 41 Clarence Road, Chesterfield, Derbyshire, England, S40 1LH.

18. Force Majeure

18.1 No Liability for Events Beyond Control: We shall not be responsible for delays or failures in performance resulting from acts beyond our reasonable control, including acts of God, strikes, lockouts, war, terrorism, pandemics, telecommunications failures, internet outages, third-party service failures, app store or platform restrictions, or mobile operating system behaviour.

19. International Use

19.1 Use Outside the UK: The App may be accessed and used outside of the UK. However, we make no representations that the App is appropriate or available for use in all locations. If you choose to access the App from other jurisdictions, you do so at your own risk and are responsible for compliance with local laws.

20. Severability

20.1 Severability Clause: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

21. Entire Agreement

21.1 Entire Agreement: This Agreement constitutes the entire agreement between you and Interactive Weather Limited regarding the use of the App and supersedes all prior and contemporaneous agreements, whether written or oral, concerning its subject matter.
